Allahabad High Court

RAMESH YADAVversusSTATE OF U.P. AND 9 OTHERS

Decided

Holding

The High Court directed the Additional Sessions Judge/Special Judge to decide the pending trial expeditiously, without unnecessary adjournments, and disposed of the application.

Summary

The applicant, Ramesh Yadav, filed an application under Section 529 of the Bhartiya Nagrik Suraksha Sanhita, 2023, seeking a direction to the Additional Sessions Judge/Special Judge (Anti‑Corruption Act) in Gorakhpur to dispose of a pending Session Trial No. 517 of 2025 (Crime No. 22 of 2018) involving offences under the IPC and Arms Act. The High Court noted that the trial had been pending since 2025 and, without addressing the merits, ordered the lower court to decide the case expeditiously and to avoid unnecessary adjournments, provided no legal impediment existed. The direction was issued to ensure compliance with the stipulated period for trial completion. The application was consequently disposed of with the said direction. The order emphasizes prompt disposal of criminal trials and limits the use of adjournments.

Issues considered

  • Whether the High Court can, under Section 529 of the Bhartiya Nagrik Suraksha Sanhita, direct a lower trial court to decide a pending criminal trial within a stipulated period.
  • Whether any legal impediment exists that would prevent the expeditious disposal of the Session Trial No. 517 of 2025.
