Allahabad High Court

MEENAKSHIversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The High Court held that, under Section 529 of the Bhartiya Nagrik Suraksha Sanhita, 2023, it may direct the ACJM to decide the pending complaint expeditiously and without unnecessary adjournments.

Summary

The applicant filed an application under Section 529 of the Bhartiya Nagrik Suraksha Sanhita, 2023, seeking a direction to the Additional Chief Judicial Magistrate (ACJM) of Gautam Buddh Nagar to decide a pending criminal complaint (Case No.2746 of 2024) involving offences under Sections 406 and 504 IPC. The High Court noted that the case had been pending since 2024 and, without addressing the merits, ordered the ACJM to dispose of the matter as expeditiously as possible, prohibiting unnecessary or prolonged adjournments. The court emphasized that no other legal impediment existed to such a direction. Consequently, the application was disposed of with the said directive. The order was pronounced by Justice Sanjay Kumar Pachori on 17 September 2026.

Issues considered

  • Whether the High Court can, under Section 529 of the Bhartiya Nagrik Suraksha Sanhita, 2023, direct an ACJM to decide a pending criminal complaint within a stipulated period.
  • Whether the court may impose a limitation on adjournments to ensure expeditious disposal of the pending case.
