Allahabad High Court

DEVENDRA @ BABLOOversusSTATE OF U.P.

Decided

Holding

The Court held that anticipatory bail should be granted to the applicant subject to conditions.

Summary

The applicant, Devendra (Babloo), was summoned in a complaint case alleging criminal breach of trust under IPC Sections 420 and 406. He filed an anticipatory bail application under CrPC Section 482, claiming innocence, lack of prior criminal record, and that the two offences cannot stand together as per Supreme Court precedent. The State opposed the bail, arguing the seriousness of the allegations. The Court examined the nature of the accusations, the applicant's cooperation, and relevant case law, including Delhi Race Club (1940) Ltd. v. State of Uttar Pradesh and Siddharam Satlingappa Mhetre v. State of Maharashtra. Finding that the criteria for anticipatory bail were satisfied, the Court granted bail with a personal bond and specific conditions. The order directed that any breach of conditions could lead to cancellation of the bail.

Issues considered

  • Whether anticipatory bail can be granted to the applicant under CrPC Section 482 in a case involving IPC Sections 420 and 406.
  • Whether Sections 420 and 406 IPC can be concurrently applied to the same set of facts as per Supreme Court jurisprudence.
  • Whether the applicant poses a risk of fleeing, tampering with evidence, or otherwise misusing bail.
