Allahabad High Court
ALI RAZAversusSTATE OF U.P. AND ANOTHER
- Decided
Holding
The Court granted anticipatory bail to the applicant subject to a personal bond and specified conditions.
Summary
The High Court of Allahabad entertained an anticipatory bail application filed by Ali Raza, who is alleged to be a marginal witness to a 1990 gift deed (hibbanama) and is implicated in Crime No. 84 of 2025 under several sections of the B.N.S. The applicant pleaded innocence and offered to cooperate with the investigation, while the State opposed bail. The Court referred to the Supreme Court’s guidelines in Siddharam Satlingappa Mhetre v. State of Maharashtra, emphasizing the need to consider the nature of the accusation, the accused’s antecedents, and the risk of fleeing or tampering with evidence. After evaluating the material and the applicant’s role, the Court found a case for anticipatory bail without expressing any view on the merits. Accordingly, the Court granted anticipatory bail on a personal bond of Rs. 50,000 with two sureties and imposed conditions restricting tampering with evidence, inducement of witnesses, travel abroad, and cooperation with the trial.
Issues considered
- Whether anticipatory bail should be granted to the applicant given the nature and gravity of the accusations under the B.N.S.
- Whether the applicant, as a marginal witness, poses a risk of tampering with evidence or fleeing from justice
