Allahabad High Court

PHOOLMATI DEVIversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The Court allowed the anticipatory bail application with conditions.

Summary

The High Court of Allahabad considered an anticipatory bail application filed by Phoolmati Devi under Section 482 of the CrPC in connection with a case registered under Sections 3, 5A, 5B and 8 of the Prevention of Cow Slaughter Act. The applicant claimed innocence, stating that the cows were recovered from a vehicle he owned and pledged to cooperate with the investigation. The State opposed the bail, invoking the seriousness of the offence. Relying on the principles laid down in Siddharam Satlingappa Mhetre v. State of Maharashtra, the Court examined the nature of the accusation, the applicant’s antecedents, flight risk and possibility of tampering with evidence. Finding that the criteria for granting anticipatory bail were satisfied, the Court allowed the application subject to a personal bond of Rs. 50,000 and four sureties, imposing conditions of appearance, non‑tampering, non‑inducement, cooperation and restriction on leaving India.

Issues considered

  • Whether anticipatory bail should be granted to the applicant under Section 482 CrPC in a case under the Prevention of Cow Slaughter Act

                                    taken into consideration.
