Allahabad High Court

UMESH KUMAR AND ANOTHERversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The Court held that anticipatory bail should be granted to the applicants under Section 482 CrPC.

Summary

The applicants, Umesh Kumar and Smt. Poonam Devi, filed an anticipatory bail application under Section 482 of the Criminal Procedure Code in a case involving alleged receipt of insurance money. They claimed innocence, asserted that a co‑accused had already been granted interim anticipatory bail, and offered to refund the amounts received. The State opposed, highlighting the sums received from Tokiyo Insurance Company. Relying on the Supreme Court’s guidelines in Siddharam Satlingappa Mhetre v. State of Maharashtra, the Court examined the nature of the accusation, the applicants’ antecedents, and the risk of fleeing. Finding that the criteria for anticipatory bail were satisfied, the Court allowed the application with a personal bond and several conditions. The order directed that the applicants be released on bail if arrested, subject to compliance with the stipulated conditions.

Issues considered

  • Whether the applicants are entitled to anticipatory bail under Section 482 CrPC in view of the alleged receipt of insurance proceeds.
  • Whether the nature and gravity of the allegations, antecedents of the accused, and risk of fleeing justify denial of bail.
  • Whether the precedent set in Siddharam Satlingappa Mhetre v. State of Maharashtra is applicable to the present facts.
