Allahabad High Court
BIHARIversusSTATE OF U.P. AND ANOTHER
- Decided
Holding
The Court granted anticipatory bail to the applicant, subject to a personal bond and prescribed conditions.
Summary
The applicant, Bihari, was implicated as the owner of a vehicle from which nine live bulls were recovered, leading to charges under several sections of the B.N.S., the Prevention of Cow Slaughter Act and the Prevention of Animal Cruelty Act. He filed an anticipatory bail application under CrPC Section 482, asserting his innocence and willingness to cooperate with the investigation. The State opposed the bail, citing the seriousness of the offences. The Court, referring to the principles laid down in Siddharam Satlingappa Mhetre v. State of Maharashtra, evaluated the nature of the accusation, the applicant's role, and the risk of flight or evidence tampering. Finding that the criteria for granting anticipatory bail were satisfied, the Court allowed the application subject to a personal bond and specific conditions. The order also empowered the prosecution to seek cancellation of bail if conditions are breached.
Issues considered
- Whether anticipatory bail should be granted in a case involving alleged illegal possession of live bulls under the Prevention of Cow Slaughter Act and Prevention of Animal Cruelty Act
- Whether the applicant poses a risk of fleeing, tampering with evidence, or influencing witnesses
- Whether the nature and gravity of the offences preclude the grant of anticipatory bail
