Allahabad High Court

KARAMVEER SINGH @ TINKU SINGHversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The anticipatory bail application is dismissed as withdrawn, with liberty granted to file a regular bail application within 30 days and protection from arrest during that period.

Summary

The applicant, Karamveer Singh, filed an anticipatory bail application under Section 482 of the BNSS in a criminal case pending trial. He later sought to withdraw the anticipatory bail application and instead move a regular bail application before the trial court, requesting protection of his liberty until that application is decided. The High Court dismissed the anticipatory bail application as withdrawn, but granted the applicant liberty to file a regular bail application within 30 days and ordered that he not be arrested during that period. The court also directed that certified copies of relevant documents be provided upon production of photocopies. Thus, the applicant’s request for anticipatory bail was not entertained, but he was given a window to seek bail without fear of arrest.

Issues considered

  • Whether an anticipatory bail application under Section 482 can be withdrawn and the applicant be granted liberty pending a regular bail application.
  • Whether the court can impose a condition that the applicant not be arrested during the period before filing the regular bail application.
