Allahabad High Court
PRADEEP ARORAversusSTATE OF U.P.
- Decided
- Bench
- AVNISH SAXENA
Holding
The Court held that, given the applicant’s low flight risk, willingness to cooperate, and absence of arrest, anticipatory bail must be granted subject to strict conditions.
Summary
The applicant, Pradeep Arora, was implicated in an FIR dated 13‑09‑2021 under Sections 63 and 65 of the Copyright Act, 1957 for allegedly possessing 53 pairs of counterfeit footwear. No arrest was made during the investigation and a charge‑sheet has already been filed. Fearing arrest, the applicant filed an anticipatory bail petition under Section 438 of the CrPC. The State opposed the bail, but the Court examined the Supreme Court’s guidelines on anticipatory bail, considering factors such as the gravity of the offence, the applicant’s cooperation, and the low risk of flight. Finding the applicant’s apprehension reasonable and the flight risk minimal, the Court granted anticipatory bail with a personal bond and several conditions, including non‑interference with witnesses and presence at trial dates. The order expressly limited its effect to the bail application and did not prejudice the trial court’s merits determination.
Issues considered
- Whether anticipatory bail should be granted to the accused under Section 438 CrPC in a copyright infringement case involving alleged counterfeit footwear.
- Whether the applicant satisfies the criteria laid down by the Supreme Court for anticipatory bail, including flight risk, cooperation with investigation, and potential for witness tampering.
