Allahabad High Court

VIKAS KUMARversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The interim anticipatory bail is made absolute, and the anticipatory bail is allowed to remain in force till the conclusion of the trial on the same terms and conditions.

Summary

The High Court considered an anticipatory bail application filed by Vikas Kumar under Section 482 of the CrPC in connection with Complaint Case No. 2452 of 2024, which alleged offences under IPC Sections 323, 307/34, and 506. The applicant claimed false implication, had no prior criminal record, and was apprehensive of arrest. An interim anticipatory bail was granted on 16 July 2025, subject to conditions including personal bond, sureties, and compliance with court directives. The court noted that the applicant had been regularly appearing before the trial court, eliminating the need for custodial interrogation. Consequently, the court converted the interim bail into absolute anticipatory bail, allowing it to remain in force until the trial concludes, subject to the same conditions, and warned that breach could lead to cancellation.

Issues considered

  • Whether the interim anticipatory bail granted to the applicant should be made absolute under Section 482 of the CrPC.
  • Whether the applicant satisfies the criteria for anticipatory bail given the nature of the alleged offences and his conduct.
