Holding

The court granted interim anticipatory bail to Vipin Jaiswal subject to prescribed conditions.

Summary

Vipin Jaiswal applied for anticipatory bail under Section 482 CrPC in connection with Crime No.423 of 2024, which alleged offences under IPC sections 319(2), 318(4), 338, 336(3) and 340(2). He claimed he was falsely implicated, noting that co‑accused Gaurav Jaiswal and Pankaj Jaiswal had already been granted bail, and that no material had been recovered from him. The State opposed the bail but did not dispute the factual assertions. The court observed that the applicant had no prior criminal record, a stable household, and had cooperated with the investigation, and therefore posed no risk of tampering with evidence or influencing witnesses. Consequently, the court granted interim anticipatory bail subject to standard conditions and ordered the filing of a counter‑affidavit.

Issues considered

  • Whether anticipatory bail should be granted to Vipin Jaiswal in view of the alleged offences and the facts of the case
  • Whether the applicant poses a risk of influencing witnesses or tampering with evidence
  • Whether the applicant's criminal history warrants denial of bail
