Holding
The Court disposed of the anticipatory bail application, allowing its withdrawal and directing that any regular bail application be decided within three weeks with a stay of coercive action.
Summary
The High Court of Allahabad heard an anticipatory bail application under Section 482 of the Criminal Procedure Code filed by Ram Vilash Yadav in connection with a case involving multiple IPC offences. The applicant, through counsel Satish Chandra Singh, sought anticipatory bail but later requested to withdraw the application and instead file a regular bail petition before the trial court. The State, represented by the Advocate General, raised no objection to this request. The Court permitted the withdrawal, directed that any regular bail application be filed within three weeks and be decided expeditiously, and ordered that no coercive action be taken against the applicant during that period. The application was consequently disposed of with a clear instruction that no further time would be granted for compliance.
Issues considered
- Whether the applicant is entitled to anticipatory bail under Section 482 CrPC in the present case.
- Whether the Court can allow the withdrawal of an anticipatory bail application and direct filing of a regular bail petition.
- Whether a stay of coercive action can be granted pending the regular bail application.
