Allahabad High Court

RAMASHRAY YADAV @ RAMASHRAY SINGH YADAVversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The anticipatory bail application is disposed of, with a direction to consider any regular bail application filed within three weeks and a stay on coercive action during that period.

Summary

The applicant, Ramashray Yadav, filed an anticipatory bail application under Section 482 of the CrPC in connection with a criminal case involving multiple IPC offences. During the hearing, the applicant sought to withdraw the anticipatory bail application and instead file a regular bail application before the trial court. The State's counsel did not oppose this request. The High Court directed that if the applicant files a regular bail application within three weeks, it will be considered and disposed of expeditiously, and no coercive action will be taken against him during that period. The anticipatory bail application was therefore disposed of with a clear order that no further time will be granted beyond the stipulated three weeks.

Issues considered

  • Whether the anticipatory bail application under Section 482 CrPC should be entertained or withdrawn in favor of a regular bail application
  • Whether the court can direct a time-bound consideration of a regular bail application and stay coercive action pending such application
