Allahabad High Court

RAJ NARAYAN YADAVversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The anticipatory bail application was disposed of, allowing the applicant to withdraw it and seek regular bail within three weeks, with a stay on coercive action during that period.

Summary

The High Court of Allahabad heard an anticipatory bail application filed under Section 482 of the CrPC in connection with a criminal case involving multiple IPC offences. The applicant, represented by Satish Chandra Singh, sought anticipatory bail but later requested to withdraw the application and instead file a regular bail application before the trial court. The State, represented by G.A., Ranjana Singh and Shesh Nath Singh Yadav, raised no objection to this request. The Court directed that the applicant may approach the trial court for regular bail within three weeks and that no coercive action be taken against him during that period. The anticipatory bail application was consequently disposed of, with a clear order that no further time would be granted to comply with the order.

Issues considered

  • Whether anticipatory bail should be granted under Section 482 CrPC in the present case
  • Whether the applicant may withdraw the anticipatory bail application and seek regular bail
