Allahabad High Court

ANAND KUMAR SINGHversusSTATE OF U.P.

Decided

Holding

The Court held that anticipatory bail is warranted and converted the interim order into an absolute bail order, subject to the stipulated conditions.

Summary

Anand Kumar Singh applied for anticipatory bail under Section 482 of the CrPC in a case involving alleged offences under Sections 406, 420, 467, 468, 417, 504 and 506 of the IPC. He argued that the FIR was lodged after a four‑year delay and was a retaliatory measure against a prior case in Tripura. The High Court initially granted interim anticipatory bail on 3 November 2025 with a personal bond and specific conditions, including non‑tampering with evidence and not leaving India without permission. The applicant complied with the interim order and appeared regularly before the trial court. On 1 October 2026, the Court converted the interim bail into absolute anticipatory bail, allowing it to remain in force until the trial concludes, subject to the same conditions, and warned that any breach could lead to cancellation.

Issues considered

  • Whether anticipatory bail should be granted despite the seriousness of the offences and the four‑year delay in filing the FIR
  • Whether the conditions imposed under Section 482 are sufficient to prevent tampering with evidence and intimidation of witnesses
  • Whether an interim anticipatory bail order can be made absolute pending trial
