Allahabad High Court
ARUN KUMAR GUPTA AND ANOTHERversusSTATE OF U.P. AND ANOTHER
- Decided
- Bench
- VIVEK KUMAR SINGH
Holding
The Court held that the interim anticipatory bail granted on 30 January 2026 is hereby made absolute and will remain in force till the conclusion of the trial subject to the same conditions.
Summary
Arun Kumar Gupta and Anil Kumar Gupta were charged under Sections 419, 420, 504 and 506 IPC in Crime No. 181 of 2019. They filed an anticipatory bail application under Section 482 of the CrPC, claiming innocence and lack of credible evidence. The High Court initially granted them interim anticipatory bail on 30 January 2026 with specific conditions. After the investigation was completed, the charge‑sheet filed and the applicants regularly appearing before the trial court, the Court found no need for custodial interrogation. Consequently, the Court converted the interim bail into absolute anticipatory bail, retaining the same conditions. The order also permitted the prosecution to move for cancellation if any condition is breached.
Issues considered
- Whether the interim anticipatory bail granted under Section 482 CrPC should be made absolute after the charge‑sheet is filed.
- Whether the applicants' regular appearance before the trial court negates the necessity of custodial interrogation.
- Whether the conditions imposed on anticipatory bail are sufficient to prevent misuse.
