Allahabad High Court
VARISversusSTATE OF U.P. AND ANOTHER
- Decided

- RAJIV LOCHAN SHUKLA
Holding
The court allowed the anticipatory bail application, granting bail subject to conditions.
Summary
The High Court of Allahabad considered an anticipatory bail application filed by Varis under Section 482 of the CrPC in connection with a case under Sections 2 and 3 of the U.P. Gangsters and Anti‑Social Activities (Prevention) Act, 1986. The applicant claimed he was falsely implicated, noting that the only base case shown against him already had him on bail and that he had no prior convictions despite nine other pending cases. The State opposed the bail but could not refute the applicant’s submissions. Weighing the lack of a conviction and the fact that the applicant was already on bail in the base case, the court deemed it appropriate to grant anticipatory bail with standard conditions. The order directed that, if arrested, the applicant be released on personal bond and surety, subject to conditions such as cooperation with police interrogation, no intimidation of witnesses, and no travel abroad without permission.
Issues considered
- Whether anticipatory bail should be granted under Section 482 CrPC in a case under the U.P. Gangsters and Anti‑Social Activities (Prevention) Act, 1986 where the applicant claims false implication.
- Whether the applicant’s prior pending criminal cases and lack of conviction justify the grant of anticipatory bail.

Mundapandey, District- Moradabad, with a prayer to enlarge him on
anticipatory bail as the applicant apprehends his arrest in the above-
mentioned case.
3. Learned counsel for the applicant submits that the applicant has been
falsely implicated in the present case. Only single base case has been

the parties.

is allowed.
