Allahabad High Court

SMT REENAversusSTATE OF U.P.

Decided

Holding

The anticipatory bail application is dismissed as not pressed.

Summary

The applicant, Smt Reena, filed an anticipatory bail application under Section 108 of the BNSS and Sections 3 and 4 of the D.P. Act in connection with Crime No. 192 of 2026. The applicant had earlier obtained a stay on her arrest through a criminal miscellaneous writ petition, which was ordered to remain in force until 28 October 2026. Counsel for the applicant argued that the anticipatory bail application was not pressed at this stage and sought its dismissal, while reserving the right to file a fresh application later if needed. The Court agreed, holding that the application was not pressed and therefore dismissed it. The order also directed the return of certified copies to the applicant’s counsel after photocopying, as per procedural rules.

Issues considered

  • Whether the anticipatory bail application filed by the applicant is maintainable and pressed in view of the existing stay of arrest.
