Allahabad High Court

ASHISH KUMARversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The Court disposed of the anticipatory bail application, permitting its withdrawal and directing that a regular bail application filed within three weeks be heard expeditiously, with a stay on coercive action during that period.

Summary

The Allahabad High Court heard an anticipatory bail application filed by Ashish Kumar under Section 482 of the CrPC, relating to offences under various sections of the BNS and the POCSO Act. The applicant’s counsel requested to withdraw the anticipatory bail petition and instead seek regular bail before the trial court, seeking a direction for speedy disposal. The opposite parties raised no objection to this request. The Court allowed the withdrawal, directing that if the applicant files a regular bail application within three weeks, it will be considered expeditiously, and that no coercive action be taken against him during that period. The anticipatory bail application was consequently disposed of with no further time granted for compliance.

Issues considered

  • Whether the anticipatory bail application can be withdrawn and replaced by a regular bail application.
  • Whether the Court can order a stay on coercive action pending the filing of a regular bail application.
