Allahabad High Court

SHIVAMversusSTATE OF U.P.

Decided

Holding

The anticipatory bail application is dismissed as not pressed.

Summary

The applicant Shivam filed an anticipatory bail application under Section 108 of the B.N.S. and Sections 3 and 4 of the D.P. Act in Criminal Miscellaneous Case No. 192 of 2026. The applicant had earlier obtained a stay on her arrest through a writ petition (Criminal Misc. Writ Petition No. 18968 of 2026) which was ordered to remain in force till 28‑10‑2026. Counsel for the applicant argued that the present anticipatory bail application was not pressed and could be re‑filed later if needed. The Court, after hearing the parties, agreed that the application was not pressed at this stage. Consequently, the anticipatory bail application was dismissed, with liberty to the applicant to file a fresh application in the future. The certified copies of the order were directed to be returned to the applicant’s counsel.
