Allahabad High Court

VIJAY CHATURVEDIversusSTATE OF U.P.

Decided

Holding

The court granted interim protection, directing that the applicant may apply for regular bail within four weeks and that no coercive action be taken against him during that period.

Summary

Vijay Chaturvedi filed an anticipatory bail application under Section 482 of the Criminal Procedure Code in connection with a criminal case (Crime No. 59 of 2026) involving alleged offences under Sections 305(B), 317(2) and 317(4) of the B.N.S., 2023. He feared arrest and sought protection to appear before the trial court and apply for regular bail. The State’s Additional Government Advocate raised no objection. The High Court allowed the applicant’s request, directing that he must appear before the concerned court within four weeks and file a regular bail application, which must be decided expeditiously and without prejudice from any earlier refusal. The court also ordered that no coercive action be taken against the applicant for the same four‑week period. The anticipatory bail application was therefore disposed with interim protection granted.

Issues considered

  • Whether anticipatory bail should be granted to the applicant under Section 482 CrPC.
  • Whether the applicant should be given interim protection to appear before the trial court and apply for regular bail.
