Allahabad High Court

TANNU SINGH @ ROSHNI SINGHversusSTATE OF U.P.

Decided

Holding

The court allowed the withdrawal of the anticipatory bail application and directed that a regular bail application be filed within three weeks, with no coercive action in the interim.

Summary

The applicant, Tannu Singh, was charged under several IPC sections in a criminal case and filed an anticipatory bail application under CrPC Section 482. After hearing, the applicant sought to withdraw the anticipatory bail application and instead file a regular bail application before the trial court. The State's counsel did not oppose this request. The High Court permitted the withdrawal, directing that the applicant file a regular bail application within three weeks, and ordered that no coercive action be taken against her during that period. The court emphasized that no further time would be granted beyond the stipulated three weeks and disposed of the anticipatory bail application.

Issues considered

  • Whether anticipatory bail should be granted to the applicant under CrPC Section 482.
