Allahabad High Court
AFROJversusSTATE OF U.P.
- Decided
- Bench
- RAJIV LOCHAN SHUKLA
Holding
The Court granted anticipatory bail to the applicant.
Summary
The High Court considered an anticipatory bail application filed by Afroj under Section 482 of the Criminal Procedure Code in a case registered under Sections 2 and 3 of the U.P. Gangsters and Anti‑Social Activities (Prevention) Act, 1986. The applicant claimed false implication, noting that she was already on bail in a single base case shown in the gang chart and had no prior convictions, though she had four other pending cases. The State opposed the relief but could not refute the applicant’s submissions. Weighing the lack of a prior conviction and the fact that the only base case already had bail, the Court deemed it appropriate to grant anticipatory bail with standard conditions. The order directed that if arrested, the applicant be released on personal bond and surety, subject to conditions such as cooperation with police, no intimidation of witnesses, and no travel abroad without permission.
Issues considered
- Whether anticipatory bail should be granted to the applicant under Section 482 CrPC in view of the pending case under the U.P. Gangsters Act and her criminal history.
