The court allowed the anticipatory bail application, subject to a four‑week period for the applicant to apply for regular bail and a stay on any coercive action.
Summary
The applicant, Sahil @ Ganju, filed an anticipatory bail application under Section 482 of the B.N.S., 2023 in Crime No. 277 of 2026, fearing arrest. He also sought permission to appear before the trial court and apply for regular bail. The State’s Additional Government Advocate raised no objection to the relief sought. The High Court granted interim anticipatory bail, directing that no coercive action be taken against the applicant for four weeks and that he must apply for regular bail within that period, with the application to be decided expeditiously and without prejudice from any earlier refusal. The court disposed of the application with these conditions.
Issues considered
- Whether anticipatory bail should be granted to the applicant under Section 482 of the B.N.S., 2023.
