Allahabad High Court

RAVINDRA YADAVversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The court allowed the interim relief, staying coercive action for four weeks and directing the applicant to apply for regular bail within that period, thereby disposing of the anticipatory bail application.

Summary

The applicant, Ravindra Yadav, filed an anticipatory bail application under Section 482 of the Criminal Procedure Code in a case involving alleged offences under several sections of the B.N.S., 2023, fearing arrest. The counsel requested that the applicant be allowed to appear before the trial court and seek regular bail, seeking interim protection in the meantime. The State’s Additional Government Advocate raised no objection to this request. The High Court granted the interim relief, directing that no coercive action be taken against the applicant for four weeks and that he appear before the concerned court within that period to apply for regular bail, which must be decided expeditiously. The court ordered that the anticipatory bail application be disposed of with these directions.

Issues considered

  • Whether anticipatory bail should be granted to the applicant under Section 482 CrPC.
  • Whether the applicant should be granted interim protection to appear before the trial court and apply for regular bail.
  • Whether a stay on coercive action against the applicant is warranted pending regular bail application.
