Allahabad High Court

SHAYAM SINGH ALIAS SWATANTRA SINGHversusSTATE OF U.P.

Decided

Holding

The interim anticipatory bail is converted into absolute anticipatory bail, and the application is allowed.

Summary

Shayam Singh alias Swatantra Singh applied for anticipatory bail under CrPC s.482 in a case involving multiple IPC offences. The High Court initially granted interim anticipatory bail on 24‑11‑2025 with a personal bond and several conditions, noting the applicant's claim of a cross‑case and lack of a specific role. The investigation later concluded, a chargesheet was filed, and the applicant regularly appeared before the trial court, eliminating the need for custodial interrogation. Considering these facts, the Court converted the interim bail into absolute anticipatory bail, allowing it to remain in force until the trial concludes on the same terms. The Court also warned that any breach of conditions could lead to cancellation of the bail.

Issues considered

  • Whether the interim anticipatory bail granted to the applicant should be made absolute given the completion of investigation and regular court appearances
  • Whether the conditions imposed under the interim bail are sufficient to prevent misuse and ensure the applicant's cooperation during trial
