Allahabad High Court

SMT RITA VERMAversusSTATE OF U.P THROUGH PRINCIPAL SECRETARY(DEPARTMENT OF LABOUR/MEDICAL SERVICES. CIVIL SECRETARIAT

Decided

Holding

The appeal is dismissed; the suspension order and the Single Judge's dismissal of the writ petition stand.

Summary

The appellant, Smt. Rita Verma, challenged a suspension order dated 24 July 2026 by filing a writ petition, which was dismissed by a Single Judge on 2 September 2026. She appealed the dismissal, arguing that the suspension was unwarranted and that she should be allowed to remain posted at Kanpur Nagar rather than her original posting at Sonebhadra. The Division Bench examined the findings of the Single Judge, noting that the petitioner was found to have committed misconduct involving the manhandling of a CMS, and that the disciplinary proceedings were pending. The court observed that the petitioner had already been restored to her original posting, and that there was no basis to overturn the suspension or to alter her posting. Consequently, the appeal was dismissed without any order as to costs, and the disciplinary proceedings were directed to be completed in a time‑bound manner.

Issues considered

  • Whether the appellate court should interfere with the Single Judge's dismissal of the writ petition challenging the suspension order.
  • Whether the alleged misconduct justifies the suspension of the petitioner.
  • Whether the petitioner is entitled to retain a posting different from her original place of posting.

Subjects

  • suspension
  • disciplinary proceedings
  • departmental inquiry
  • writ petition

                                Versus

State Of U.P Through Principal
Secretary(Department Of Labour/Medical
Services. Civil Secretariat And 3 Others .....Respondent(s)

Counsel for Appellant(s) : Akhilesh Kumar
Counsel for Respondent(s) : C.S.C.

Court No. - 39
             HON'BLE SAUMITRA DAYAL SINGH, J.
             HON'BLE SWARUPAMA CHATURVEDI, J.

1. Having heard Shri Akhilesh Kumar, learned counsel for the
appellant and Shri Sri Arimardan Singh Rajpoot, learned Additional
Chief Standing Counsel for the State-respondents.

2. We find no good ground to offer any interference in the order of the
learned Single Judge dated 02.09.2026 in Smt. Rita Verma versus
State of U.P. and 3 Others 2026:AHC:183694.

3. By that order, the learned Single Judge has dismissed the writ
petition filed against the suspension order dated 24.07.2026.

4. To the extent, the act of misconduct has been spelt out against the
petitioner and that has been taken note of by the learned Single
Judge-being one involving manhandling the CMS, no room survived
to offer any interference with the suspension order.

5. As to equities, pending departmental inquiry, suffice to note that in
the present fact the petitioner has been restored to her original place
of posting i.e. Sonebhadra. Merely because, that may not be a place
of liking of the petitioner, may not have prompted the learned Single
Judge to allow her retention at Kanpur Nagar, which was not her
original place of posting.

6. Let the disciplinary proceedings be completed in a time bound
                                                                                       SPLA No. 1119 of 2026
                                                                 2

                                    manner.

                                    7. Accordingly, we find no merit in the appeal and it is dismissed. No
                                    order as to costs.
