Allahabad High Court

SMT. AASTHA SHARMAversusSTATE OF U.P. THROUGH SECRETARY HOME AND 3 OTHERS

Decided

Holding

The transfer application is dismissed for want of prosecution.

Summary

The applicant, Smt. Aastha Sharma, filed a transfer application under Section 407 of the Criminal Procedure Code seeking to move a criminal case (State Vs Prashant Kaushik and others) from the ACJM Court‑5 in Ghaziabad to the District Court in Meerut and to stay the proceedings. The application was listed but no counsel appeared on behalf of the applicant to press the matter. The court noted that despite notice to the opposite parties, they also did not appear. Because the applicant was not represented, the court dismissed the transfer application for want of prosecution. Consequently, any interim order was vacated and any pending applications were disposed of.
