Allahabad High Court

INDRAJEETversusSTATE OF U.P. AND 6 OTHERS

Decided

Holding

The petition is dismissed; the petitioner must approach the appropriate authority under Section 67 of the U.P. Revenue Code, 2006.

Summary

Indrajeet filed a public interest litigation seeking a writ of mandamus directing the State officials (respondents 2 and 3) to initiate proceedings under sections 136 and 67 of the Uttar Pradesh Revenue Code, 2006 against alleged encroachers on a Banjar land parcel in Jaunpur. The respondents' standing counsel objected, contending that the petitioner has an alternative remedy by filing an application under Section 67, relying on the Court's earlier decisions in Amaruddin Ansari v. State of U.P. (PIL No.655 of 2026) and Kanhaiya Lal v. State of U.P. (2023 ADJ 226). The High Court held that the alternative remedy suffices and dismissed the petition, granting the petitioner liberty to approach the appropriate authority under Section 67. Any subsequent application by the petitioner will be considered according to law.

Issues considered

  • Whether a writ of mandamus can be issued to compel initiation of proceedings under sections 136 and 67 of the U.P. Revenue Code, 2006 in a PIL concerning encroachment on Banjar land.
  • Whether the petitioner has an alternative statutory remedy that bars the court's intervention.
