Allahabad High Court

MAHENDRA KUMARversusSTATE OF UTTAR PRADESH AND ANOTHER

Decided

Holding

The petition is dismissed for lack of locus standi.

Summary

The petitioner, an advocate, filed a public interest litigation seeking an order directing the State to publish the marks, cut‑off marks and evaluated answer sheets of the L.T. Grade Teachers Examination 2025 to ensure transparency. The court observed that the petition did not disclose any personal interest or standing of the advocate in the matter, merely noting his profession. It held that filing a PIL without any genuine concern or locus standi misuses the advocate’s position and cannot be permitted. Consequently, the petition was dismissed with a warning to the petitioner to exercise caution in future filings. No substantive examination of the merits of the transparency request was undertaken.

Issues considered

  • Whether an advocate has locus standi to file a public interest litigation concerning the publication of examination marks and answer sheets without a direct personal interest.
  • Whether the petition is maintainable as a public interest litigation.

Subjects

  • Public Interest Litigation
  • Locus Standi
  • Exam Transparency
  • Advocate Misuse
  • Petition Dismissal

                                    Chief Justice's Court
                                                    HON'BLE ARUN BHANSALI, CHIEF JUSTICE
                                                    HON'BLE KSHITIJ SHAILENDRA, J.

                                    1. This petition, purportedly in public interest, has been filed by the
petitioner, an Advocate, seeking a direction to the respondents to publish
the marks and cut-off marks of L.T. Grade Teachers Examination 2025
and provide copies of evaluated answer sheets to the candidates by
ensuring transparency in future recruitment examination.

                                    2. A perusal of the petition indicates that except for indicating that
petitioner is an Advocate, no credentials have been indicated in the
petition as to how the petitioner, an Advocate, has any cause in relation to
                                    L.T. Grade Teachers Examination 2025.

                                    3. Apparently, on someone approaching the petitioner as an Advocate, the
present petition has been filed by becoming a petitioner, by the petitioner
                                    as an Advocate.

                                    4. Filing of petitions by Advocates as PIL in relation to the cause for
which, they have no concern whatsoever, is essentially misusing the
position as an Advocate, which cannot be countenanced.

                                    5. Warning the petitioner to take care in future, the petition is dismissed.

(Kshitij Shailendra, J) (Arun Bhansali, CJ)
