Holding
The PIL is dismissed without any further liberty.
Summary
The petitioner, Anupam Dwivedi, filed a public interest litigation seeking eviction of private respondents from Arazi No.2213/0.137 hectare, despite a pending civil suit (Mansoor Ahmad v. State of U.P., Suit No.1277 of 1999) and an interim status‑quo order dated 20‑12‑1999. The earlier writ petition (Writ‑C No.42247 of 2023) had ordered eviction on 28‑03‑2023, which the petitioner argued ignored the pending suit and interim order. The High Court noted that the interim order was not placed on record in the PIL and that the petitioner now wished to withdraw the petition. After hearing counsel, the Court allowed the withdrawal and dismissed the PIL without granting any further liberty. The matter was ordered to be detagged and listed separately before the appropriate bench.
Issues considered
- Whether the PIL seeking eviction can be entertained despite a pending civil suit and an interim status‑quo order.
- Whether the order dated 28‑03‑2023 for eviction can be executed in view of the pending suit.
- Whether the petitioner’s request for withdrawal of the PIL is permissible.
