GAYA LALversusSTATE OF U.P. AND 8 OTHERS

Decided

Holding

The Court directed the respondent No.4 to decide the pending case under Section 67 of the U.P. Revenue Code, 2006 within three months, after hearing the parties.

Summary

The petitioner, Gaya Lal, filed a public interest litigation seeking a direction to the fourth respondent to decide a pending case (No. 15815/2026) involving Gaon Sabha and alleged illegal encroachers, which is being heard under Section 67 of the Uttar Pradesh Revenue Code, 2006. The petitioner argued that the proceedings have been unduly delayed since July 22, 2026, to the advantage of the encroachers. The Court examined the petition and found merit in the request for timely adjudication. Consequently, the Court ordered the fourth respondent to pass an appropriate order on the pending proceedings within three months of receiving a certified copy of the order, after hearing the parties. The petition was disposed of with the said direction.
