Allahabad High Court

RAKESH SINGHversusSTATE OF U.P. AND 6 OTHERS

Decided

Holding

A PIL is not maintainable where a remedy under Section 67 of the Uttar Pradesh Revenue Code, 2006 is available.

Summary

The petitioner sought a writ directing the removal of illegal encroachments by respondents 6 and 7 on a 0.607‑hectare pond (Gata No.217) in Barahi Sahora village, Budaun. The Court noted earlier orders granting time to the standing counsel, which were not utilized. It relied on a Division Bench decision in Amaruddin Ansari v. State of U.P. (PIL No.655 of 2026) that a public‑interest litigation is not maintainable where the villagers have a specific remedy under Section 67 of the Uttar Pradesh Revenue Code, 2006. Consequently, the Court disposed of the petition, allowing the petitioner to approach the appropriate authority under the said statutory provision. Any application filed under Section 67 concerning Gata No.217 will be decided according to law.

Issues considered

  • Is a public‑interest litigation maintainable when a specific statutory remedy under Section 67 of the Uttar Pradesh Revenue Code, 2006 is available to the aggrieved villagers?
