Summary

Raju Prajapati filed a public interest litigation seeking a direction to the State of U.P. and other respondents to act against alleged illegal constructions on Plot Nos. 687 and 692 in Village Deepapur, Jaunpur. The petitioner asked the court to compel respondents 2 and 3 to initiate action against encroachers identified as respondents 5 to 10. The court examined instructions dated 16‑12‑2025 from the Deputy District Magistrate, which reported several encroachments and the registration of cases under Section 67(1) of the U.P. Revenue Code, 2006. The court noted that the revenue team had already initiated proceedings (Case Nos. T‑202514360629542, T‑202514360629543, T‑202514360629545, T‑202514360629546). Accordingly, the petition was disposed with a specific direction to the Judicial Tehsildar of Mariyahu to decide the pending cases under Section 67(1) within three months of receiving the certified order. The order was pronounced by Hon’ble Justice Arun Kumar on 7 May 2026.
