Allahabad High Court

SHASHIKANT RAIversusSTATE OF U.P. AND 5 OTHERS

Decided

Holding

The court held that, having completed the enquiry and found no wrongdoing, there was no reason to continue the public interest litigation.

Summary

The petitioner filed a public interest litigation seeking a court direction for the respondents to complete an enquiry and take legal action against respondent No.6 within a set time. The court examined the instructions and noted that a detailed inspection report dated 26 September 2025, prepared by the Finance and Statistical Officer, Mau, found no wrongdoing and was accepted by the District Panchayat Raj Officer, Mau. Since the enquiry had been completed and no misconduct was detected, the court found no basis to continue the PIL. Consequently, the court disposed of the petition without ordering any further action. The decision was delivered by the Chief Justice and a Justice of the Allahabad High Court on 7 May 2026.

                                                HON'BLE ARUN BHANSALI, CHIEF JUSTICE
                                                HON'BLE KSHITIJ SHAILENDRA, J.

                                    1. This petition, purportedly in public interest, has been filed by the
petitioner seeking a direction to the respondents to conclude the enquiry
and take legal action against respondent no. 6 within a stipulated period.

                                    2. Instructions were produced inter-alia indicating that the report has been
obtained, however, further action was not indicated.

                                    3. Today, fresh instructions have been produced inter-alia indicating that
detailed inspection report dated 26.09.2025 has been produced by the
Finance and Statistical Officer, Mau, wherein no wrongdoing was
detected and the said report has been accepted by the District Panchayat
                                    Raj Officer, Mau.

                                    3. In view of the above fact situation, once the enquiry has been
undertaken and no wrongdoing has been found, we do not find any reason
to further continue with the present Public Interest Litigation. The same
                                    is, accordingly, disposed of.

(Kshitij Shailendra, J) (Arun Bhansali, CJ)
