Allahabad High Court
MOOL ADIVASI JANJATI KALYAN SANSTHA AND ANOTHERversusSTATE OF U.P. AND 4 OTHERS
- Decided
Holding
The petition is dismissed as not pressed.
Summary
The petitioners, Mool Adivasi Janjati Kalyan Sanstha and another, filed a public interest litigation seeking mandamus directing the State of Uttar Pradesh and a recruitment board to conduct a transparent enquiry into alleged fraudulent caste certificates and to prevent such candidates from being appointed. The petition also sought any other appropriate relief and costs. After hearing arguments, the petitioners themselves, through counsel Ram Kumar Gautam, requested that the petition be dismissed as not pressed, allowing them to pursue the matter before the appropriate authority. The Court considered whether the petition was pressed and whether it was appropriate for the High Court to entertain the relief sought. Finding that the petition was not pressed, the Court dismissed the writ petition, granting the petitioners liberty to approach the competent forum. No costs were awarded.
