Allahabad High Court
DARA SINGHversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
The Court held that the respondent must constitute the Departmental Promotion Committee and expeditiously decide the petitioner's promotion claim.
Summary
Petitioner Dara Singh filed a writ petition challenging the delay in his promotion to Workshop Superintendent, alleging that the Departmental Promotion Committee (DPC) had not been constituted as required by law. The petitioner argued that the promotion process, which had been initiated, remained incomplete, violating his service rights. The Court examined the procedural requirements for constituting a DPC and noted that the department had failed to form the committee. Relying on service law principles, the Court directed the respondent to promptly constitute the DPC, consider the petitioner's claim along with similarly situated employees, and determine the effective date of promotion. The writ petitions were consequently disposed of with these directions.
