Allahabad High Court

JAGANNATH PRASAD SINGHversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The Court ordered the Chief Medical Officer to verify the petitioner’s medical bills and forward the reimbursement file within three weeks, thereby disposing of the petition.

Summary

The petitioner, Jagannath Prasad Singh, filed a writ petition seeking a mandamus directing the State to forward his medical reimbursement file, submitted on 18 April 2025 for Rs.107,051, to the Chief Medical Officer (CMO) of Ghaziabad for decision. The petition alleged that the respondent (the State and its officials) had not acted on the file, causing delay in reimbursement. The Court examined whether the CMO had a statutory duty to verify and forward the bills and whether a writ of mandamus could be issued to compel such administrative action. It held that the CMO was required to verify the medical bills and forward the file for reimbursement within a reasonable time. Accordingly, the Court directed the respondent (CMO) to verify the bills and forward them within three weeks and disposed of the writ petition.
