Holding
The writ petition is disposed of with a direction to the authority to consider the petitioner’s representations, and no mandamus for salary payment is granted.
Summary
Shrikant Sharma, an Assistant Teacher who has been functioning as Officiating Principal (Karyawahak) since 1 July 2019, filed a writ petition seeking a mandamus directing the State of Uttar Pradesh and other respondents to pay him the salary of a regular Principal for the period he acted in that capacity, along with arrears, benefits and interest. He relied on recent judgments of this Court, notably the Veeresh Chandra Mishra case, which held that an officiating principal is entitled to the higher salary from three months after assuming the ad‑hoc post. The petitioner also cited the Satya Prakash Sharma and Surendra Prasad Agnihotri decisions supporting service benefits for officiating principals. The Court examined these precedents but concluded that the writ petition should not be entertained for salary relief; instead, it directed the concerned authority (District Inspector of Schools) to consider the petitioner’s representations dated 8 April 2026 and 29 April 2026 within two months, provided no legal impediment exists. Consequently, the petition was disposed of with the said direction, without granting the mandamus for salary payment.
Issues considered
- Whether an officiating principal is entitled to the salary of a regular principal for the period of officiation.
- Whether the petitioner is entitled to a mandamus directing payment of salary differential, benefits and interest.
- Whether the representations filed by the petitioner on 8 April 2026 and 29 April 2026 must be considered expeditiously by the District Inspector of Schools.
