Allahabad High Court
MOHAMMAD IMRAN AND 32 OTHERSversusSTATE OF U.P. AND 3 OTHERS
- Decided

- MANJU RANI CHAUHAN
Holding
The Court declined to grant mandamus and instead directed the petitioners to make fresh representations and the respondents to decide them within a stipulated period.
Summary
The petitioners, 33 teachers serving as In‑charge Headmasters, filed a writ petition seeking a mandamus directing the State to pay their salaries and arrears pursuant to a Government Order dated 16‑07‑2026 and to decide pending representations, citing a prior judgment of 30‑04‑2025. The respondents argued that any fresh representation should be considered in accordance with law. The Court, without adjudicating the merits, ordered the petitioners to file fresh, fully‑supported representations before the District Basic Education Officer within three weeks and directed the respondent to decide the matter within two months, issuing a reasoned order. No salary payment or mandamus was granted. The petition was therefore disposed.
Issues considered
- Whether the respondents are liable to pay salary and arrears to the petitioners as In‑charge Headmasters under the Government Order dated 16‑07‑2026.
- Whether a writ of mandamus can be issued directing the respondents to decide the petitioners' pending representations in light of the earlier judgment dated 30‑04‑2025.
- Whether the court may direct the petitioners to make fresh representations and set a timeline for decision.
