Holding

The court dismissed the writ petition and directed the petitioner to make a fresh detailed representation before the District Basic Education Officer, who must decide the matter within a stipulated time.

Summary

The petitioner, a retired Assistant Teacher as of 31 March 2025, filed a writ petition seeking a direction for the respondents to pay his pension and related retirement benefits, which he claimed were pending despite a prior representation. The respondents argued that the petitioner must file a fresh, detailed representation before the District Basic Education Officer, Ballia, for consideration. The High Court, without expressing an opinion on the merits, dismissed the petition and ordered the petitioner to submit a fresh representation within three weeks, attaching a certified copy of the order. The court further directed the respondent to decide the matter expeditiously, preferably within six weeks, after providing a hearing and a reasoned order.
