Allahabad High Court

RAKESH KUMAR SINGH PALIversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The court held that, in the absence of any legal impediment, it may issue a mandamus directing the Secretary of the U.P. Basic Education Board to consider and decide the petitioner's representation within two months.

Summary

The petitioner, Rakesh Kumar Singh Pali, filed a writ petition seeking a mandamus directing the Secretary of the U.P. Basic Education Board to consider his candidature for district allotment and to decide his representation dated 27.05.2026. He alleged that despite having higher quality point marks, other candidates with lower marks had been allotted districts, and his grievance remained unresolved. The court, after hearing counsel, noted the Apex Court's orders on allotments but did not opine on the merits of the petitioner's claim. It issued a direction to the Secretary to consider and decide the representation expeditiously, preferably within two months, provided there is no legal impediment. No costs were awarded, and the writ petition was disposed with the said direction.

Issues considered

  • Whether the High Court can issue a writ of mandamus directing the Secretary of the U.P. Basic Education Board to consider and decide the petitioner's representation for district allotment.
  • Whether any legal impediment exists that would preclude the court from directing such administrative action.
