Allahabad High Court

BABITA SRIVASTAVAversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The Court ordered the respondents to consider and decide the petitioner’s representation within twelve weeks, without adjudicating the merits, and disposed the petition.

Summary

Petitioner Babita Srivastava, a stenographer in the Public Works Department, Prayagraj, filed a writ petition seeking mandamus directing the respondents to regularize her service and grant benefits under the old pension scheme, as well as to decide her representation dated 17‑08‑2026. The petition also relied on Supreme Court pronouncements in Special Appeal No. 21/2022 and SLP (Civil) No. 11915/2022. The High Court, after noting that the petitioner had already made a representation, declined to examine the merits and instead directed respondents No. 2 and 3 to consider and decide the representation within twelve weeks, providing a hearing to all parties. The order was issued strictly in accordance with law, and the petition was disposed.
