Allahabad High Court

HARE RAM PANDEY AND ANOTHERversusSTATE OF U.P. AND 5 OTHERS

Decided

Holding

The court held that the petition may be dismissed as withdrawn while granting the petitioners liberty to challenge any subsequent orders.

Summary

Petitioners Hare Ram Pandey and another filed a writ petition before the Allahabad High Court. During the hearing, counsel for the petitioners sought to withdraw the petition, requesting that they be allowed to challenge any orders that might be passed thereafter. The court considered whether a petition could be withdrawn at that stage while preserving the right to contest future orders. It held that the petition could indeed be withdrawn, provided the petitioners were given liberty to approach the court later on any subsequent orders. Accordingly, the writ petition was dismissed as withdrawn with the said liberty.
