NISHA BHARTI AND 2 OTHERSversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The court directed Respondent No.3 to consider and decide the petitioners' representations within twelve weeks, without examining the merits, and disposed the petition.

Summary

The petitioners sought mandamus directing the Uttar Pradesh Health Department to consider their claim for six‑month pre‑promotion training, include them in the list of eligible health workers for a January 2026 training, publish a seniority list of women health workers in Azamgarh, and act on their representations dated August and November 2025‑2026. The court, noting that the petitioners had already represented their grievance, found no merit in keeping the petition pending. It ordered Respondent No.3 to consider and decide the representations within twelve weeks, after giving a hearing to all concerned parties. The court expressly stated that it had not examined the merits of the petition and was acting strictly in accordance with law. Consequently, the petition was disposed of following the directive.

and the order shall be passed strictly in accordance with law.
