Allahabad High Court

SOURABH JURELversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The Court disposed of the writ petition, directing the respondent authority to decide the petitioner’s representation for compassionate appointment within twelve weeks, after hearing all heirs.

Summary

The petitioner, Sourabh Jurel, claimed a compassionate appointment under the Uttar Pradesh Recruitment of Dependents of Government Servants Dying in Harness Rules, 1974, after his father died on 6 December 2022. He filed a representation with the respondent authority on 2 December 2025, which remains undecided. The petitioner filed a writ petition seeking direction for the authority to consider his claim. The learned Standing Counsel argued that the petition was unnecessary since the petitioner had already approached the authority. The Court held that the writ petition could be disposed of but the authority must decide the representation expeditiously. Accordingly, the Court ordered the respondent to decide the petitioner's claim within twelve weeks, after hearing all heirs, and disposed of the writ petition.

Issues considered

  • Whether the writ petition is maintainable when the petitioner has already approached the respondent authority
  • Whether the respondent authority is obligated to decide the representation for compassionate appointment within a reasonable time

                                    Counsel for Respondent(s) : C.S.C.

                                    Court No. - 33
                                                         HON'BLE MANISH KUMAR NIGAM, J.

                                    1. Contention of learned counsel for the petitioner is that father of the petitioner died
on 6.12.2022 and thereafter, petitioner has claimed compassionate appointment under
the Uttar Pradesh Recruitment of Dependents of Government Servants Dying in

                                    offered to the petitioner.

                                    2. Learned Standing Counsel has submitted that since the petitioner has already
approached respondent authority, no useful purpose would be served in keeping this
                                    writ petition pending.

                                    3. Accordingly, the writ petition stands disposed of with a direction to respondent
authority to consider and decide the representation of petitioner for compassionate
appointment, in accordance with law, expeditiously, preferably, within twelve weeks
from the date of production of a certified copy of this order after providing
opportunity of hearing to all the heirs of deceased employee, provided there is no
