Allahabad High Court

SURESH KUMAR YADAV AND 4 OTHERSversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The Court directed the respondents to decide the petitioners' application within twelve weeks and disposed of the petition without adjudicating the merits.

Summary

The petitioners filed a writ petition seeking a mandamus directing the respondents to decide their application dated 22 May 2026 and to grant a 10% annual honorarium increment for the period 1 April 2018 to 31 March 2024. The learned Standing Counsel argued that the petition was no longer necessary as the petitioners had already been represented. The Court, after considering the submissions, ordered respondents No.2 and No.4 to decide the petitioners' application within twelve weeks, after giving a hearing to all parties, and clarified that it was not examining the merits of the increment claim. The order was issued strictly in accordance with law. Consequently, the petition was disposed of.

Issues considered

  • Whether the High Court can issue a mandamus directing the respondents to decide the petitioners' pending application within a stipulated time.

                                    1. This writ petition has been filed for the following relief:

                                    2. Learned Standing Counsel has submitted that as petitioners have already
represented, no useful purpose would be served in keeping this petition pending and it
would be appropriate that respondent be directed to consider the grievance of the
                                    petitioners in accordance with law.

                                    3. In view of these facts, respondent Nos. 2 and 4 are directed to consider and decide
the application dated 22.05.2026 of the petitioners in accordance with law, after
providing opportunity of hearing to all the concerned parties, expeditiously, preferably
within a period of twelve weeks from the date of production of certified copy of this

                                    4. It is made clear that this court has not examined the matter on merits and the order
