Allahabad High Court

VIPIN KUMAR AND 2 OTHERSversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The petition is dismissed as it is already covered by the earlier judgment in Manish Kumar v. State of U.P., with a direction to the respondent to act on the pending recommendation.

Summary

The petitioners sought a writ of certiorari to quash Advertisement No.17-Examination/2026 for the post of Pashudhan Prasar Adhikari and a writ of mandamus directing the respondent to grant them provisional permission to apply online and appear for the main examination. The High Court noted that the matter had already been decided in Writ A No.13674 of 2026 (Manish Kumar vs. State of U.P. and others) and that the present petition was therefore disposed of in accordance with that judgment. The Court directed Respondent No.1 to consider the recommendation made by Respondent No.4 dated 17‑08‑2026 and to take a decision within ten days, subject to hearing and absence of any other legal impediment. No substantive ruling on the merits of the advertisement or the mandamus relief was made. The petition was consequently dismissed as it was covered by the earlier order.

Issues considered

  • Whether Advertisement No.17-Examination/2026 is legally valid and can be quashed by a writ of certiorari.
  • Whether the petitioners are entitled to a writ of mandamus directing provisional permission to apply online and appear in the examination.
