Holding
The petition is disposed, with a direction to the competent authority to consider individual representations and pass reasoned orders on salary re‑fixation and arrears within six weeks.
Summary
Eleven petitioners, who are government employees, filed a writ petition seeking a mandamus directing the respondents to re-fix their salaries with the first increment as of 01‑01‑2017, to pay regular monthly salaries thereafter, and to compute and disburse all arrears arising from such re‑fixation. The Court noted that the matter had already been decided in the earlier writ (Seema Ray & 3 Others v. State of UP & 5 Others, Writ A No.481 of 2026). Accordingly, the Court disposed of the present petition, directing the competent authority to consider any representations submitted by the petitioners, examine each claim in light of statutory provisions, Government Orders and the observations in Seema Ray, and to pass a reasoned order for each petitioner within six weeks of receiving the representations.
Issues considered
- What relief, if any, can be granted to the petitioners regarding re‑fixation of salary, regular payment, and arrears?
- Whether the Court should issue a mandamus directing the respondents to fix salaries and pay arrears, or refer the matter back to the competent authority in view of the earlier decision in Seema Ray.
