MOHD TAUFEEQversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The writ petition is disposed by directing the petitioner to make a fresh representation before the District Basic Education Officer, who must decide the claim within a stipulated period.

Summary

Mohd Taufeeq, a retired Class‑IV employee (peon) who retired on 31‑01‑2025, filed a writ petition seeking the release of his General Provident Fund (GPF) and arrears of salary with interest. The petitioner alleged that despite retirement, the dues had not been paid. The court, after hearing counsel, did not express an opinion on the merits but directed the petitioner to file a fresh, detailed representation before the District Basic Education Officer, Firozabad, within three weeks, attaching a certified copy of the order. The respondent was instructed to consider the representation, afford a hearing, and decide the claim within six weeks, if no legal impediment exists. Thus, the writ petition was disposed without a substantive order on the claim itself.

Heard learned counsel for the petitioner and learned Standing
Counsel for the State-respondents.

This writ petition has been filed with the prayer to direct the
respondents to grant and release the due GPF and arrears of salary,
along with interest from the due date, in favour of the petitioner, in
accordance with law.

Learned counsel for the petitioner submits that the petitioner was
appointed to the post of Class-IV employee and was allowed to work

petitioner retired from the post of peon on 31.01.2025, however, the
GPF and arrears of salary, along with interest, have not been paid till

to consider and decide the claim of the petitioner within a stipulated
period.

Learned Standing Counsel submits that in case the petitioner moves
a fresh representation before respondent no.2, ventilating his
grievances, an appropriate order shall be passed, in accordance with
